Introduction
On May 14, 2009 Governor Markell signed into law two bills (Senate Bill #30 as amended by Senate Amendment #1 and Senate Bill #31 as amended by Senate Amendments Nos. 1 and 2) that amend Title 28 of the Delaware Code. I have listed some of the highlights of the changes; however, the entire laws can be viewed by clicking on the DE Law tab.

Senate Bill #30 relates to No Limit Texas Hold'em Poker Tournaments
Highlights of the changes are:

  • eliminates the no limit phrase from the chapter
  • adds definitions to the Chapter ["Bookkeeper or Treasurer"; "Re-buy"; "Sit and go"]
  • mandates that facilities only conduct one (1) tournament a day
  • allows organizations to have five (5) tournaments per calendar year instead of 4
  • establishes sit-and-go games
  • adds language to appeal the Board's decision to Superior Court
  • allows the Board to prescribe the value of prizes by their rules and regulations
  • Senate Bill #31 relates to Bingo and Charitable Gambling – (CASH GAMES)
    Highlights of the changes are:

  • increases the monetary payout of the "cookie jar bingo" game
  • increases the value of certain prizes
  • allows reasonable compensation to be paid to person(s) assisting in the conduct of the function(s)
  • allows no limit on the amount a person may bet
  • no person may lose more than $150 in a single day
  • no Bingo or Charitable Gambling may take place after 1:00 a.m.
  • sponsoring organizations shall be allowed to use third party vendors to supply equipment and workers for Charitable Gambling events
  • changes from 15 to 30 days for after occasion reports to be filed
  • allows the Board to impose fines upon a licensee and third party vendor for violations of the law or regulations



    Note to the Charitable Organizations:
    The Charitable Gambling event would be held under your organization's name and minimal staff from your organization would need to be involved. This is a great way for your organization to have successful fundraisers with very little work and very minimal involvement. Having a Charitable Gambling event (cash games) is an easy way for your organization to have a fundraiser on a monthly basis at a cost of only $15 per month. You don't want to miss out!!
